UAB Obamas Online Store Terms and Conditions
Effective from 16 September 2026
1. Seller and scope
1.1. These Terms and Conditions of Sale (the Terms) govern purchases made at www.obamas.lt and set out the rights and obligations of the Buyer and the Seller.
1.2. The Seller is UAB “Obamas”, company number 304431741, VAT number LT100010641717, registered address Rudmenos g. 5, LT-52193 Kaunas, Lithuania, email sales@obamas.lt, telephone +370 647 02838.
1.3. A Buyer is a natural or legal person purchasing from the online store. A Consumer is a natural person acting for purposes outside their trade, business, craft or profession.
1.4. The consumer protection rights described in these Terms apply to Consumers. Legal persons and natural persons buying for professional or business purposes are not entitled to special consumer rights, including the 14-day right of withdrawal, unless the Seller agrees otherwise in writing.
1.5. The version of the Terms in force when the order is placed applies to that order. Amendments do not apply retroactively to contracts already concluded.
2. Orders and conclusion of the contract
2.1. Purchases may be made by adults with full legal capacity, minors with parental or guardian consent where required by law, legal persons and duly authorised representatives.
2.2. The Buyer selects the goods, quantity and options, delivery and payment method, provides the information required to fulfil the order and, after reviewing the Terms, clicks the button used to place the order.
2.3. Placing an order constitutes the Buyer’s offer to enter into a sales contract. The contract is concluded when the Seller confirms by email that the order has been accepted for fulfilment. An automated acknowledgement of receipt is not acceptance if it clearly states that additional approval by a manager is required.
2.4. Where manager approval is required, the Buyer will be informed by email or contacted within the time stated in the online store.
2.5. If the Seller cannot accept the order, the Buyer will be informed and any advance payment will be refunded without undue delay using the same payment method, unless otherwise agreed.
2.6. Contract and order information is stored for the period required by law. The order confirmation is supplied to the Buyer by email on a durable medium.
3. Goods, prices and payment
3.1. The main characteristics of each product are shown in its description. Images are illustrative. Actual colour or packaging may vary slightly due to display settings or manufacturer changes, but the goods must conform to the agreed description, quantity, quality and purpose.
3.2. Prices are shown in euros and include VAT unless expressly stated otherwise. Delivery charges and any other additional costs are clearly displayed before the order is placed.
3.3. The Buyer may use any payment method offered during checkout. The applicable payment conditions are displayed before the order is placed.
3.4. Where advance payment is selected, fulfilment begins after payment is received, unless the online store states otherwise.
3.5. Promotions and discounts are governed by the conditions announced for them. Changes do not affect orders already concluded.
4. Delivery and transfer of goods
4.1. Available delivery methods, prices and estimated delivery times are shown during checkout. Unless otherwise agreed, goods will be delivered to a Consumer no later than 30 days after the contract is concluded.
4.2. The Buyer must provide an accurate delivery address and all other necessary information. Reasonable additional costs caused by incorrect or incomplete information may be charged to the Buyer.
4.3. The risk of accidental loss or damage passes to the Consumer when the Consumer, or a third party designated by the Consumer other than the carrier, physically receives the goods. If the Consumer independently appoints a carrier not offered by the Seller, risk passes when the goods are handed to that carrier.
4.4. The Buyer is advised to inspect the parcel and its contents on delivery. Any damage, shortage or incorrect item should be noted on the carrier’s document, photographed and reported promptly. Failure to do so does not remove the Consumer’s statutory rights.
4.5. If delivery is delayed, the Buyer may contact the Seller and set a reasonable additional delivery period. Where provided by law, the Buyer may terminate the contract and obtain a refund.
5. Consumer’s right of withdrawal
5.1. A Consumer may withdraw from a distance sales contract within 14 calendar days without giving any reason, subject to the exceptions in Section 6.
5.2. The period begins when the Consumer, or a designated third party other than the carrier, receives the goods. If goods from one order are delivered separately, it begins when the last item is received.
5.3. Before the deadline, the Consumer must send a clear withdrawal statement by using the “Withdraw from the contract” function in the online store, by email to sales@obamas.lt, by post to Rudmenos g. 5, LT-52193 Kaunas, Lithuania.
5.4. Use of the model form is optional. A clear statement identifying the Consumer and the order is sufficient. The Seller will acknowledge receipt of an electronic withdrawal without delay by email or another durable medium.
6. Exceptions to the right of withdrawal
6.1. The right of withdrawal does not apply in cases provided by law, including goods made to the Consumer’s specifications or clearly personalised, such as custom-mixed paint; goods liable to deteriorate or expire rapidly; sealed goods unsuitable for return for health protection or hygiene reasons once unsealed; goods inseparably mixed with other items after delivery; and other statutory exceptions.
6.2. Opening packaging does not by itself remove the right of withdrawal, except where a statutory exception applies. The Consumer is, however, liable for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
7. Returns and refunds
7.1. After withdrawal, the Consumer must send or hand the goods back to the return address specified by the Seller within 14 calendar days of notifying the Seller.
7.2. The Consumer bears the direct cost of returning conforming goods unless the Seller agreed to bear it or failed to inform the Consumer of this obligation before the contract. The Seller bears reasonable return costs for defective or incorrectly supplied goods.
7.3. Goods should be securely packed and accompanied by information identifying the order. Original packaging is not an absolute condition of return, but damage to or loss of it may be considered when assessing diminished value.
7.4. Within 14 calendar days of receiving the withdrawal notice, the Seller will refund all payments received under the contract, including the cost of the least expensive standard delivery offered by the Seller. Extra costs caused by the Consumer choosing a more expensive delivery method are not refunded.
7.5. The Seller may withhold the refund until the goods are received or the Consumer supplies evidence of return, whichever occurs first.
7.6. Refunds are made using the original payment method unless the Consumer expressly agrees otherwise and incurs no additional cost.
8. Conformity and statutory guarantee
8.1. The Seller is liable for a lack of conformity existing at delivery and becoming apparent within two years, unless the law or a commercial guarantee provides a longer period.
8.2. The Consumer should contact the Seller and provide information showing the purchase and the defect. Proof of purchase may be established by any appropriate evidence, not only a paper receipt.
8.3. For non-conforming goods, the Consumer may first require free repair or replacement unless the chosen remedy is impossible or would impose disproportionate costs.
8.4. The Consumer may obtain a proportionate price reduction or terminate the contract in circumstances provided by law, including where repair or replacement has not been completed properly, the defect recurs, the defect is serious, or the Seller refuses to remedy it. The contract may not be terminated for a minor defect.
8.5. Where the Consumer chooses repair instead of replacement, the statutory guarantee period for goods purchased on or after 31 July 2026 is extended once by an additional year. The Seller will inform the Consumer of the choice between repair and replacement and of the extension applicable when repair is chosen.
8.6. For products covered by statutory repairability requirements, the manufacturer or, where provided by law, its representative, importer or seller may also be required to offer repair after the statutory guarantee has expired, within a reasonable time and for a reasonable price.
8.7. A manufacturer’s or Seller’s commercial guarantee does not limit the Consumer’s statutory rights.
9. Account and personal data
9.1. The Buyer may purchase with an account or as a guest where this option is available.
9.2. The Buyer must provide accurate information, keep it updated and protect login details. Unauthorised account use must be reported immediately.
9.3. Personal data is processed under the Privacy Policy published in the online store. Messages necessary to fulfil an order are not direct marketing.
9.4. Marketing communications are sent only where there is a valid legal basis. Marketing consent is separate, voluntary and may be withdrawn at any time.
10. Liability
10.1. Each party is liable for failure to perform its obligations in accordance with applicable law.
10.2. The Seller may temporarily restrict access where the Buyer threatens the security of the store or infringes the law or third-party rights. This does not cancel existing contracts or statutory Buyer rights.
10.3. Nothing in these Terms excludes or limits mandatory Consumer rights.
11. Complaints and disputes
11.1. Complaints may be sent to sales@obamas.lt or UAB “Obamas”, Rudmenos g. 5, LT-52193 Kaunas, Lithuania. Please include the order number, a description of the issue, the requested remedy and available evidence.
11.2. The Seller will provide a reasoned response to a Consumer’s written request within 14 calendar days of receipt, unless the law provides otherwise.
11.3. If the Consumer is dissatisfied with the response or receives none in time, the Consumer may contact the State Consumer Rights Protection Authority, A. Goštauto g. 12, LT-01108 Vilnius, Lithuania, www.vvtat.lrv.lt, or submit an application through the Lithuanian Consumer Rights Information System (VTIS).
11.4. The parties will first attempt to resolve disputes amicably.
12. Final provisions
12.1. Lithuanian law applies. This choice does not deprive a Consumer resident in another country of mandatory protection granted by the law of that country where applicable.
12.2. If any provision is invalid, the remaining provisions continue in force.
12.3. The Terms are available in Lithuanian, English, Russian and Polish. Translations are provided for convenience. In case of discrepancy, the Lithuanian version prevails to the extent that this does not restrict mandatory Consumer rights.
